1/15 The people who want to wipe out independent contractors are changing their messaging.

Pay attention to what’s happening right now in the press. Our opponents are trying to shift the narrative—with impeccable timing, ahead of upcoming congressional hearings on our issue.
2/15 Two days ago, this story ran in the Los Angeles Times. In its first paragraph, the writer suggests (falsely) that virtually all independent contractors are being victimized by algorithms that are being used to determine things like pay rates.

3/15 The story is based on “research” by Veena Dubal—a name well known to us. She’s one of the “researchers” whose work underpinned the mess in California that led to the #FreelanceBusting ABC Test law known as #AB5.

1/4 Dear @bcmerchant,

You wrote:

"If you’ve ever worked for an on-demand app platform, or for Amazon, or even as an independent contractor at all in the last few years, there’s a good chance that you’ve been discriminated against — by an algorithm."

latimes.com/business/techn…
2/4 What a wildly inaccurate lede.

App-based workers, or what researchers using IRS data call OPEs, make up less than 10% of all the independent contractors in the country.

In other words, the vast majority of ICs have *nothing to do* with pay rates set by algorithms.
3/4 In fact, study after study (after study after study) shows that most of us are happy with our choice to be independent contractors.

We're not being discriminated against.

My excitement over @KevinKileyCA goes back— it’s the journey that makes the story. In the CA legislature, we know we will lose most battles, but he fought them for us. He gave homeschooling families a voice, impacted #AB5 independent contractors. He sued the governor & won…
What you may not know is that we were helpless to stop bills like AB5, and he came back to fight it again the next session. We took losses. But now, they won’t get the PRO Act through if it goes party line. They can’t do that harm to others nationwide. Because we have Kiley.
Going from disenfranchised and inflicted to now holding the power to stop it— it’s an amazing turn of events. Because nobody stopped fighting even when things were so bad hope was hard to believe in. We never gave up on each other. And, they won’t get the chance to do it again.

[THREAD] Dear @PattyMurray , I received an email from you today earnestly asking for input. You wrote "I can’t tell you how important your voice is to me. What I hear from folks like you in Washington state drives everything I do in the other Washington." So I wrote you back...1/
Unfortunately, my email was returned undeliverable. Strange, since you so desire to hear from the public. So I thought I'd copy my letter here.
Senator Murray:
I am a one-issue voter.
I live in California under the crushing oppression of #AB5, now a.k.a #AB2257. 2/
This law has made California independent solo business owners like me ( I am a marketing consultant, writer and illustrator) unable to earn a living as before, because our clients and prospects understandably fear misclassification fines. 3/

Dear @GavinNewsom I sit here realizing that you are spending every day, fighting to keep your job, and the career you’ve built. You are trying to make the case that you should keep your job, and that’s a pretty terrible feeling. 1/
The irony is not lost on me that in early 2020, I was one of thousands of California freelancers, calling your office and the offices of my assembly person and senator, asking for help to keep my own livelihood, one I’d worked to build over a period of years, harmed by #AB5 2/
I called daily, wrote letters, took meetings with lawmakers explaining my #smallbusiness And while I got some sympathetic listening, there was no action taken to help professionals like myself from being cast aside. Frustrating as heck. 3/

If you’re a freelancer or independent contractor, the #PROAct comes down to risk management. We have decent control over the risks in our business. Work hard, price right, diversify your clients/industries/skills and you’ll stay busy. 1/11

#NoPROAct #FightForFreelancers
But there are also exogenous risks. #Freelance clients disappear for a variety of reasons, many of them beyond our control. 2/11
Over the course of 22 years, I’ve lost biz to budget cuts, bankruptcies, PMs or editors who retired or moved to different companies, and full-time people hired to do the work I was doing as a #freelancer. Stuff happens. 3/11

I truly don't understand why every employer, every Chamber of Commerce across the country isn't loudly opposing #PROAct. Our economy as we know it will cease to exist if it passes. If you're believing that #ABCTest doesn't completely do away w/ICs you're sorely mistaken
When #AB5 was signed into law I thought it didn't apply to me b/c I wasn't subject to CA's Wage Orders. It only applied to ppl subject to Wage Orders, @LorenaSGonzalez and @veenadubal assured everyone (I have receipts). They (a legislator and a law professor) were wrong.
They just said "whoops" and moved on. By relying on their tweets instead of reading the bill I wasn't prepped for msgs from clients on 12/27/19 that my contracts would b canceled 1/1/20 b/c of #AB5. Pls don't let this happen to you. Read the bill yourself. congress.gov/bill/117th-con…

Biden sort of campaigned on this, at least by publicly supporting #AB5 in California, so he certainly signaled that he’d be on board with it. So did Kamala.

➡️ Hey #entrepreneurs, #TwitterMarketing, and ANYONE who is #selfemployed

‼️EVERYONE should know this information that's being buried in the news cycle:

‼️The PRO Act, or HR 842‼️👎

...…📵🔊 threadreaderapp.com/thread/1366805…
The voting date is scheduled for 03/08! (aka THIS Monday!)

🚨Remember the heavily OPPOSED smack-down that #California imposed on millions of #independentcontractors?

That they are ‼️STILL‼️ fighting? The law that says you cannot even do #Rideshare unless @uber, @lyft, @Grubhub
... EMPLOY you as an official employee of the company. 😱

Even IF they could afford to do that (and these companies have ALREADY said they CANNOT,) you could not:

🔸set your own schedule
🔸where you want to work
🔸or any other #sidehustle - GONE

Not sure if you’re in this 📦?

Hello, freelancers/independent contractors and the people who hire us who are just now learning about the #PROAct. Are you still assuming this is “a California problem” or “freelance writers’ issue”? This is your wake up call. It’s a nationwide and cross-industry issue now. 1/6
Everyone in the U.S. who works or hires freelance needs to pay attention to this + quickly. This includes writers, publicists, per diem nurses, independent E.R. doctors, respiratory therapists, accountants, marketing specialists, graphic artists, photographers ... 2/6
video editors, website developers, interpreters, or musicians, et al.

Legislation introduced in the House and Senate contains an antiquated employment classification test which most professional independent contractors cannot pass. 3/6

1/A thread re:the appointing a new Secretary of State to replace @AlexPadilla4CA & the likely problems if @GavinNewsom selects @LorenaSGonzalez

History: I was in the Assembly when Kevin Shelley resigned & @Schwarzenegger chose Bruce McPherson to replace him
2/ Kevin resigned after people "accused Shelley of abusive behavior toward his staff."

This followed the recall of Gray Davis. Republicans were happy to topple another state constitutional officer.

A similar "domino effect" could happen w/@LorenaAD80

3/ We've seen @LorenaSGonzalez draw the ire of corporations after #AB5 -> to Prop 22

We've also seen her conduct unprecedented campaign money laundering, transferring corporate funds to her husband- @SupFletcher - when he ran for Supervisor in 2018.

If you live in California, you have been blitzed by messages to vote for #Prop22, a rule that would allow Uber, Lyft, Postmates and other money-losing, destructive bezzles to continue to abuse their employees through the fiction that they are "independent contractors."

1/
Prop 22 is the most expensive ballot initiative in California history, with a pricetag of $186m and counting, money transfered from the never-to-be-profitable app companies that have destroyed so many Californian businesses and lives.

2/
These companies launched with deep cash reserves from the Saudi royals, funneled through Softbank, and they were a bet that they could monopolize our state's transport, logistics and food by losing money on every transaction until all the real, money-making businesses failed.

Mrs. Amazon counsel is pontificating again. Time to shut that crazy down. There is absolutely no reason why she should have so much power over how we work while she sits in her multi-million dollar house paid by her Mr.
It’s easy to ruin people’s lives in the name of progress when you’ve been a career student your whole life and then marry a sugar daddy. Try working a real job, starting your own business and then let’s see how your spoiled ass feels about #AB5.
It’s also easy when you score a rich professional athlete baby daddy, whose significant child support pmts you don’t have to report so you can continue to play the “I’m a poor Latina from the hood” card and use it to advance your political career and awful progressive laws.

This is exactly the attitude that gets us these laws. She works for US. WE pay her salary. She is supposed to represent US. It is not the American way to beg legislators we put into power to please spare us. We fire them. #AB5
As an immigrant, I feel like it’s my duty to warn Americans about the road we’re on. The reason we scream at these “progressive” movements and laws is because this is exactly what brought us to America. These are tyrants who want to control every aspect of our lives.
They play on your emotions making you feel guilty about your “white privilege” and how things might be made right by taxing everything into submission. All while the ruling class lives in their armed communities and send their kids to charter schools….
