First an element of context, AG Szpunar is not any AG at the Court, but the 'First Advocate General'. His Opinion comes after the much noted and commented Opinion of AG Rantos in the #Superleague case.
The (most) interesting bit of his Opinion in my view relates to the interpretation of Article 165 TFEU and its relationship to the European Sports Model. (See paras 48-55).
Molti confondono le federazioni nazionali (in Italia la @FIGC di Gravina) con le leghe (@SerieA di Casini e De siervo). Le federazioni sono legate alla Uefa e ceferin per interessi propri e giochi di potere. Le leghe sono legate ai club ed ai loro interessi. Oggi anche la ➡️
Premier league si è espressa a favore della superlega (chissà perché le 6 inglesi erano già interessate 16 mesi fa)come lo fa Casini con queste parole. Dal summit di Londra di oggi appare evidente questa spaccatura tra interessi politici delle federazioni, che sono delle 'Uefa'➡️

Partiamo dal concetto popolare che il tribunale non conta nulla. Non é così. Sicuramente la parola fine (in un verso o nell'altro) la metterà la Corte di Giustizia Europea, ma intanto la UEFA si é fermata contro i club proprio per il lavoro fatto del tribunale di Madrid.

Poi, un'altra cosa da far drizzare i capelli che abbiamo sentito: la sentenza del tribunale di Madrid riguarda solo la Spagna. Ma assolutamente no, infatti le sanzioni sono state ritirate per tutte le squadre che erano state punite.

The first really interesting part of the Opinion concerns the AG's assessment of the relevance of Article 165 TFEU and the European Sports Model in the case (§§27-42).

Nella stagione 19/20 la Uefa ha distribuito 242,8 milioni di contributo solidale ai club non partecipanti alle competizioni europee. Prima della pandemia, il contributo aveva raggiunto quota 275,2 milioni. La #Superleague prometteva 10 miliardi in 23 anni, 435 milioni annui.
A chi andrebbero questi 435 milioni? La #Superleague prevedeva 20 club: 12 noti, 3 presumibili e 5 da invitare. Facciamo che i 5 siano invitati dalle top 5 leagues: chi sta fuori? Shakhtar, Zenit, Ajax e Benfica, a mero titolo di esempio. Anche a loro spetterebbe la solidarietà.

Glede na sorazmerno prijazen odziv na komentarje v zvezi z (brezvezno) nogometno superligo, poskušam svoje razmišljanje nekoliko podrobneje predstaviti. Izhajam pa iz vseživljenjskega spremljanja angleškega nogometa. #SuperLeague
Spominjam se otroštva, ko mi je oče pripovedoval o časih, ko je povprečen prvoligaški nogometaš v Angliji na teden zaslužil približno toliko kot pismonoša.
Kasneje sem se lotil preverjanja te legende. Res je bilo tako v prvih desetletjih poklicnega nogometa, tam nekje do dvajsetih let prejšnjega stoletja (dodatne premije nogometašev, žepnina ob prestopih in bonitete v pubih niso bile vštete v plače nogometašev).
