These are industries where Black and brown workers are over-represented and have a higher risk of death.

In general, BIPOC workers are more likely to be exposed to workplace hazards than white workers and are at greater risk of injury, illness, & death 3/

In 2015, when I was #OSHA Administrator, I visited Korea and met with #Hyundai and #Kia top management, to warn them of the poor safety management and the risk to workers in their supplier manufacturing facilities in Georgia and Alabama. 2/
Some background: It is cheaper to manufacture automobiles in the southern US than in South Korea.
As labor and other costs rose in South Korea, #Hyundai & #Kia opened assembly plants in Alabama & Georgia, bringing their suppliers and subsidiaries to open plants nearby. 3/

Lehman points to nurses who testified they fear getting fired for being unvaxed, after working for 9 months of pandemic before #vaccine became available.

We're nine minutes out from the Court taking the bench. First up today will be arguments on whether to stay the #OSHA vaccinate-or-test mandate. /1
All of the justices except Sonia Sotomayor will be in the courtroom for oral argument today. Justice Sotomayor, who is diabetic, will be participating from her Chambers by phone. Also, Ohio Solicitor General Ben Flowers will argue by phone as he tested positive for COVID. /2
We'll hear first from Scott Keller, who will argue for a coalition of businesses led by @NFIB. Then is Flowers for a coalition of States led by Ohio. And arguing for the government and in defense of OSHA will be U.S. Solicitor General Elizabeth Prelogar. /3

#SCOTUS will hear argument on two of the Biden Admin's #vaccinemandates today: the OSHA ETS for large employers (up first at 10am ET) and the CMS rule for health care workers (immediately following at 11am ET).
The Fifth Circuit imposed an initial stay on the OSHA ETS. After cases were consolidated in the Sixth Circuit, that Court lifted the stay. #SCOTUS is deciding whether to reimpose a stay on the ETS pending further litigation.

A short thread on the opposition to #OSHA’s Emergency Temporary Standard.

The rule is a straightforward public health measure which requires large employers to insist that workers who are not vaccinated be tested weekly and wear a mask, to avoid infecting other workers. 1/
Opposition to this rule is being led by the retail industry and aided by 3 highly partisan judges who have already made blatantly political ruling.

I ran OSHA for 7 years – please allow me to explain how outrageous this opposition is. 2/
First, the retail industry seems to have forgotten that workplace exposures have played a central role in driving the pandemic. There have been hundreds of COVID outbreaks traced to retail establishments, with thousands of sickened workers and shoppers. 3/

The OSHA ETS is NOT legal nor enforceable. Employers do not worry, this is easier to fight than you think.

I have almost 20 years experience in this field and OSHA knows this is absolutely ridiculous and laughable.
Trying to say that a vaccine is a control that falls on the hierarchy of controls is not accurate. It would have to attempt to fall under the elimination aspect of the hierarchy and the vaccine does not eliminate covid-19.

OSHA wants to fine under serious violation, they don't have the manpower to do so & the non-compliance w/ forced vaccination is not a serious violation. They would have to prove that covid-19 has the LIKELIHOOD of death or serious bodily harm. IFR does not support this. #OSHA

@OSHA_DOL will issue a mandatory standard later this month that will likely conflict with actions by @GovAbbott and some other governors to end virus exposure prevention efforts in businesses.

1/ Apparently #OSHA has updated guidance on #ventilation in the workplace wrt to #COVID19 prevention. See thread 👇by @AliNouriPhD.

BUT ... I looked into their explanations on how SARS-CoV-2 is spread & precautions. Their statements are woefully insufficient or inaccurate.
2/ Specific OSHA guidance on ventilation is weak, but okay. Tho "Ensure all HVAC systems are fully functional" or "Upgrade to MERV 13 or higher filters where feasible" isn't exactly ground-breaking at this point.

3/ More shocking to me is that the #OSHA summary of "How does COVID-19 spread?" reflects all sorts of inaccurate or unclear statements that were never true & that most agencies eventually expunged long ago.

On now, Dave Perkins of @dialogues360 presenting results of study on 5 #ASMecosystems in #SouthAfrica. #Data variability is a persistent research challenge and also needs coordination across partners in the ecosytem. @DelveASM confirms this as a problem of global scale.
Cost of compliance, lack of access to capital, markets & weakened institutional support to #ASM sector in #SouthAfrica are validated as barriers in this sector. Impact of these factors pale in comparison to the policy/ reg vacuum w/in whichsector operates. Policy schizophrenia.
.@dialogues360 argues, and I concur, that time is of the essence in influencing the new policy process launched by the government of #SouthAfrica on formalizing the #ASM sector, ideally convened by a neutral, honest broker party.

Because a job is so central to one's well-being and various forces make jobs hard to replace, risks are higher when leaving a negative review of your employer than a restaurateur or hotelier. Image
Employers can and often do use discourage current & former employees from surfacing negative information.

For instance, over 1/3 US workers report being bound by nondisclosure clauses (per @evanpstarr), which bleed into nondisparagement & lawsuit risk (@OrlyLobel).

The #rateofspread is very concerning. If #dental personel were worried in March/April, #July could be much worse.
We should not be too concerned about #aerosols; we need to be concerned about #communityspread. If July results in a #outbreak, #dentaloffices will be more at risk than ever, just from the odds of more infections in the population.

"In Hartsdale, New York, one Trader Joe’s employee has tested positive for the coronavirus, and another has been diagnosed as a suspected case by their doctor, according to one current and former employee...
"....Erica Mildner worked at the #Hartsdale store until she quit March 20 after being sent home for asking to wear gloves, which previously were not explicitly permitted by the corporate office. [ #OSHA ] is now investigating her case.......
"....Mildner said she does not trust Trader Joe’s guidelines regarding whether a store is closed for a deep cleaning.
'We all know it takes a few days to feel symptoms, get access to a test, and then get the results of that test,' Mildner said....."
