What is a Madhhab?
Part 1. Usūl

On this 6th of Sha’ban 1444, we continue our series of posts on #metafiqh in preparation for our introductory publication.

A madhhab is compromised of five levels of legal infrastructure.

1. Usūl
2. Fiqh
3. Fatwā
4. Qadā’
5. Taqnīn Image
Level 1. Usūl

This is the evidenciary level of the madhhab’s infrastructure. It represents a heurmenutucal system through which revelatory texts are interpreted. Image

the following are derived:
a. creedal tenets
b. spiritual tenets
c. quranic exegesis
d. legal rulings

Prophetic Character With One’s Wife

As ridiculous assertions continue to be made about Rasūlullāh ﷺ, the one of الخلق العظيم, I’m compelled to say that the correction below is incomplete and has not highlighted the most important points regarding the narration at hand….
1 The *issue* over which Rasūlullāh ﷺ is “disciplining” Lady ‘Aisha is insistence upon his *love and loyalty* to her when she doubted. In simple terms, he is putting her heart at rest. Does that context have any parallel whatsoever with aggressive assertion of spousal authority?
2 By the explanation of Sh. Gibril, that the ‘gentle correction’ is means of removing waswas & conferring blessings, this report is clearly informing of a PROPHET-SPECIFIC action (khāsiyyah), which is not legislated for others. Who dares claim that their striking has such effect?

Fiqh & Fatwā

A true faqīh…

He was asked a fiqh question. He said —

1. If you’re seeking fatwa (‘ilm in context), then ask the people of your locality

2. If you’re seeking (‘ilm in itself, non-contextual), then the ruling is what Imām Abū Hanīfa has stated…
I bring attention to this because, the crux of #metafiqh is to distinguish between non-contextual and contextual rulings and to delinate the process of reaching contemporary codification. It’s a pioneering effort. May Allah grant highest tawfīq and avert all envious eyes…
May Allah bless the true fuqahā’ and grant us from their adab and ‘ilm and guide us through their deep understanding and keep us firm upon their way. آمين

Some classical scholars have posited that the seeds of the fitra still ripe in the Arabs was of the causes they were chosen as first recipients of the Revelation. In our current discourse on Islam donning the cultural garb of its ‘host’ society, this is a critical point to note..
Islam will affirm cultural expressions that run parallel to its ethical imperative, but it will also refine and elevate them. This requires a transcendance above exclusively worldly objectives. Culture is often rooted in the earthly. Religious culture is rooted in the celestial.

“The one in whose heart love has settled, can’t find it in himself to leave praise [of Rasūlullāh ﷺ]…”

Reflect deeply on what happens to Religion when it loses its spiritual element. It loses its HUMAN element (the heart).

When people ignorantly criticize the mawlid …
saying the sahaba loved Rasūlullāh ﷺ more than anyone yet never celebrated his mawlid, they should ask themselves — was the connection of the sahaba to Rasūlullāh ﷺ just through the mind or did they have a HUMAN CONNECTION to him?

Was their love manifest in words or deeds?
There’s absolutely no comparison between the sahaba & us. Allah be well pleased with them. They gave their lives for Rasūlullāh ﷺ. Today, we give almost nothing for this Religion and then sit around criticizing prophetic inheritors for calling to his love ﷺ through the mawlid

#Tasawwuf is an integral part of how we find meaning in our lives. We can behold Allāh, thereby fostering gnosis, or internalize it as being attached to the ego. The latter often leads to anxiety, depression, self-rejection, various forms of addiction, and even suicide…
What is so critical to understand is that the process of finding meaning and healing is a *devotional*, not a cognitive, nor academic one. This sets tasawwuf distinctly apart from any psychological method, be it ‘Islamic’ or otherwise.
This doesn’t mean there’s no place for psychology, it just means that it doesn’t take the place of tasawwuf. Tasawwuf draws upon God for strength. Psychology draws upon the mind (ego). Tasawwuf targets root ailments of the heart. Psychology provides techniques for symptomic care.

Now, vastness is attributed to the sensual while restriction is attributed to the spiritual, of detriment to both faith & fitra…

I think you’ll find much satisfaction in the #2025project.

I tend to agree. Perhaps it is because scholars are so busy putting everyone else in their place that they’ve forgotten their own.

Knowing that role is a higher tier of scholarship which most haven’t reached.
You might agree, though, that interdisciplinary skill isn’t achieved through mere dual-degrees? That’s why I devised #metafiqh

Time, money, and intellectual freedom are constraints, but - more importantly - sound methodology that preserves tradition without impeding growth.
As for those who feel the need to denigrate others to elevate themselves, I think we all know the answer to that. If a trait isn’t befitting for ‘normal’ people, it is a stronger aversion in a (so-called) scholar.
