The 2009 criminal contempt case commences in #SupremeCourt.

Sr adv Rajeev Dhavan says the matter should go to a Constitution Bench, given teh significance it has. He adds Attorney General must also be heard.
Dhavan adds the question about whether any reference to corruption by judges would amount to contempt or not should be heard only by a Constitution Bench.

He refers to a revised set of questions submitted by Bhushan a day ago.

Thread on Indian SC proceedings in #PrashantBhushan contempt case. This makes for a fascinating read. side note #lka does not have an analogous Contempt of Court law (different aspects of contempt of court are provided in other laws) which would cover the facts of this case (1/4)
which means judges in #lka won't have the same statutory limitations that the Indian SC has. This is dangerous & many have been calling on Parliament for years to enact a contempt of Court law.

Justices Arun Mishra, BR Gavai and Krishna Murari are part of the bench.
Sr adv Dushyant Dave starts by referring to review jurisdiction of the court and the plea by Bhushan to defer the punishment till the review petition is filed and decided.
"I have 30 days to file the review petition and the order (convicting Bhushan) can then be reviewed. So please defer this hearing today," argues Dave.

Justice Mishra retorts: "But this remedy is consequential. You can file a review after our final orders."

The SC judgement in #PrashantBhushan case has excellently parsed the difference between criticism of a judge as an individual (for which no contempt but private civil route exists) and the criticism in judicial capacity (for which contempt can and has been invoked). 1/3
So unlike anarchists claim, the SC has held that it is NOT holding #PrashantBhushan in contempt for bike comment (comment against CJI as in individual) but for patently FALSE statement against CJI (as judge) that SC is in lock-down when court is hearing thousands of cases. 2/3

Glad the Apex Court has initiated suo motu contempt proceedings against Mr Prashant Bhushan. This should have been done long back.
Bhushan needs to be given an exemplary punishment. The majesty of the highest court of the land has to be upheld by a lawyer. He can not defame SC.
Glad Hon'ble SC has held this serial offender Prashant Bhushan guilty of contempt of court. Hope he is given an exemplary punishment when the quantum of sentencing is decided on 20th.
