3◾Düşünün lise sondayız, koskoca insanlarız ama okul çıkışlarına bile gelirdi çoğu kez. Ancak bilenler bilir, bizim zamanımızda kredili sistem diye bir şey vardı. Yani ders saatleri karmaşıktı, o yüzden kandırmamız kolaydı anne babalarımızı.

2/ The two initial charges were baseless, devoid of credible evidence, and politically motivated. He is currently in prison under a third equally baseless charge, that of ‘espionage’, which would require him to have been in possession of secret information. This is absurd.
3/ For almost three years, the authorities have attempted to find it but there isn’t a crime to be found.

Bayraktar: the initial detention was based on two articles of the TR penal code - art 309 (attempting to overthrow the constitutional order) and art 312 (attempting to overthrow the government). For 15 months he was kept in prison not knowing what these charges was based on.
Bayraktar: after almost two years, his detention under art 309 was lifted in October 2019, without any indictment drawn under this charge. During this time his prosecution under art 312 carried on and he was acquitted.

Oh my goodness. Huge, huge news from Turkey. #OsmanKavala has been acquitted in the #GeziPark trial along with all the other defendants, which we @BarHumanRights have been monitoring - with growing and grave concern.

But big questions remain. Why was this case prosecuted at all? Why did it go on so long based on such fundamental flaws, Kavala detained for some 2.5 years? The case strongly suggests judicial proceedings being used to harass critics. These are still frightening times in Turkey.

Many international human rights organisations, inc @BarHumanRights, have been fiercely critical of the indictment, and the failure to rely on any material evidence in Kavala’s case.
This is now backed by the ECtHR assessment on the absence of facts, information or evidence.

Another important aspect - despite previously finding in Mehmet Altan and Sajjan Alpay’s cases that Art 5(4) had been complied with, the ECtHR now explicitly says Turkish Constit Ct does not have carte Blanche when dealing with similar complaints where liberty is at stake.
