Justice Swarana Kanta Sharma made the observation while overturning the trial court's judgement discharging Sharjeel Imam, Safoora Zargar and nine others from the case.
The court says that the protest organised by the Jamia students of which Imam, Zargar and others were part of was not peaceful resistance but a violent protest which ultimately turned into riots.
“Protest by violent means can never be part of democracy. State can restrict the right to #protest by certain ways without violating fundamental rights of individuals,” #DelhiHighCourt while framing charges against #SharjeelImam, others in 2019 #JamiaViolence case.
“The video analysis will also reveal that the acts of resistance being presented as normal by the present respondents were not peaceful resistance but violent protest which had turned into riots,” Justice Swarana Kanta Sharma observed in the order running into 90 pages.

Justice Swarana Kanta Sharma had reserved her verdict on March 24 after hearing Delhi Police and the respondents for nearly two hours.
The trial court had discharged Imam and others in February 2023. In its order the court had strongly criticised the Delhi Police for its shoddy investigation and had said that Imam and others were merely scapegoats.
