A division bench of Chief Justice Satish Chandra Sharma and Justice Subramonium Prasad made the observations while dismissing PIL by @AshwiniUpadhyay challenging notifications of RBI and SBI that permit exchange of Rs. 2000 currency notes without requirement of any ID proof.

@AshwiniUpadhyay has also prayed that RBI and SBI be directed ensure that the Rs. 2000 currency notes are deposited in respective bank accounts only, so that the no one can deposit money in other accounts and people having black money could be identified easily.

Senior Advocate Parag Tripathi appearing for RBI said that the RBI’s recent decision is not demonetisation and is only an exercise of currency management. He suggested that the matter be heard on a later date as judgment has already been reserved in similar PIL.

On the other hand, it is the petitioner’s case that RBI has no independent power under RBI Act to take such decision. The PIL has been filed by advocate Rajneesh Bhaskar Gupta.
